The Labor Contract Law establishes that:
The number of vacation days depends on your length of service as of December 31.
If the employee does not meet the minimum required time, a proportional scheme must be applied.
If by December 31 the employee does not have the necessary length of service to qualify for the full period, the proportionality rule set by law applies.
Specifically, the regulation states that when an employee has less than 6 months of service as of December 31, they are entitled to 1 vacation day for every 20 days worked.
The proportional calculation depends on the hire date and the time worked up to December 31.
There are three main scenarios:

To enable “Proportional Days for New Hires”, follow these steps:
- Go to admin.humand.co.
- Access the Vacations and Leaves module and create or edit the policy.
- Go to the Benefit Increase Special Adjustments section.
There you will find the option “Proportional Days for New Hires”, which must be enabled for the system to automatically calculate the proportional days.
To enable the “Proportional Days for New Hires” feature, the policy must be set as follows: Annual frequency, Accrual timing: Start of cycle, and Activity period: Oct–Sep. If the policy does not meet this configuration, you will not be able to enable this option.

If the employee is hired between January 1 and June 30, by 12/31 they will have more than 6 months of service.
As a result, on October 1 they are granted the 14 base days established by Argentine law (initial tier).
- No days are granted at the time of hire.
- On October 1 the full 14 days are credited.

If the employee is hired between July 1 and September 30, by 12/31 they will not have 6 months of service.
As a result, on October 1 they are granted proportional days, calculated from the hire date to 12/31.
For the proportional calculation:
- Only business days (Monday to Friday) are counted.
- Saturdays and Sundays are not counted.
- Holidays do not affect the count: each week always adds 5 days.
- The legal rule applies: 1 vacation day for every 20 business days worked.
Specific example
Hire date: July 5, 2025.
Business days from hire date to 12/31/2025: 128.
128 ÷ 20 = 6.4 → on October 1 they are granted 7 days (proportional). -
If the employee is hired between October 1 and December 31, proportional days are granted at the time of hire, calculated from the hire date to 12/31.
For the proportional calculation:
- Only business days (Monday to Friday) are counted.
- Saturdays and Sundays are not counted.
- Holidays do not affect the count: each week always adds 5 days.
- The legal rule applies: 1 vacation day for every 20 business days worked.
Specific example
Hire date: November 5, 2025.
Business days from hire date to 12/31/2025: 41.
41 ÷ 20 = 2.05 → 3 days (proportional) are granted at the time of hire.
This way, the system ensures that new hires receive the correct number of days when they do not meet the minimum length of service requirements as of December 31.
